There were calls for organizing and participating in another illegal action on October 26, 2019 on social networks, by the organization Democratic Choice of Kazakhstan (DCK), recognized by the court as an extremist, and its supporters.
Members of this organization are hiding from justice abroad for especially serious crimes.
They incite the population to illegal actions, thereby creating a threat to the safety of people, their life and physical health, causing damage to their property, disrupting the normal functioning of society.
These people’s actions threaten public safety and public order are unacceptable and subject to restriction, since they contradict the norms of the Constitution and the laws of the country, Articles 19, 20, 21 of the International Covenant on Civil and Political Rights.
In accordance with Article 13 of the Law “On Countering Extremism”, peaceful meetings, rallies, marches, pickets and demonstrations involving extremist organizations, the use of their symbols, and the dissemination of extremist materials are not allowed.
In this regard, state bodies will take strict measures to the organizers and participants of unauthorized protests in the manner prescribed by law.
In cases of confirmation of the facts of participation in illegal actions, the offender will be asked about liability under Article 488 of the Code of the Republic of Kazakhstan on Administrative Offenses (fine up to 50 MCI, arrest up to 15 days).
If these actions cause substantial harm to the rights and legitimate interests of citizens, organizations, society or the state, then criminal liability arises (Article 400 of the Criminal Code - organizing or participating in an unauthorized action if they have caused significant damage).
In order to prevent crime, protect human rights and freedoms, the General Prosecutor’s Office urges citizens not to succumb to provocative calls and to refrain from participating in illegal actions by extremist organizations.
